Do my loved ones still need to apply for probate if I have a Will?

Having a Will does not automatically eliminate the need for a probate application. It does determine whether the application to the probate registry is for a grant of probate, letters of administration with Will annexed or an application in the absence of a valid Will.

The necessity of a grant depends on the nature and value of the assets to be transferred, as well as who they are to be transferred to. How long does probate take?

The time needed to complete the probate process depends on the assets involved parties involved, and this can vary immensely. There is a six-month window to submit the application for probate in matters where inheritance tax is due, before a penalty fee applies. In all matters, where inheritance is and is not due, the current timescale for the grant of probate to be issued is 12 weeks. After a grant is issued, the administration of the estate typically takes a further 6-12 months, depending on the assets involved. We will always provide updates throughout any matter to ensure you are aware of the process, delays and timescales involved.

What is a deed of variation?

A deed of variation can be prepared to vary, or amend, the terms of a Will after someone has passed away, usually to maximise use of a tax relief. In order to be effective, the beneficiaries must all agree to the change in terms and this should typically be done before applying for probate.
